Fagen Friedman & Fulfrost attorneys have significant experience in every facet of public education labor law, as well as other areas of employment law. Many of our attorneys have served as chief negotiators and bargained on behalf of school districts. Our experience includes traditional bargaining as well as interest based bargaining (IBB). Several attorneys in each of our offices are certified as IBB trainers. We have engaged in all steps of impasse, factfinding, strike preparation, and unfair labor practice proceedings before the Public Employment Relations Board. We also have advised clients regarding union certification, decertification, and unit modification. We have represented clients with respect to both academic/certificated and classified bargaining units, and have litigated, among other things, agency fee issues.
We have represented clients in all areas of employment law, including advising on and responding to discrimination, harassment, and retaliation complaints filed with the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, and related litigation. We have advised regarding the Family Medical Leave Act as well as the California Family Rights Act, the employment and release of certificated and classified employees, extended leaves of absence issues. We also have engaged in all manner of employee discipline proceedings and layoffs, including resulting appeals by way of litigation. We have reviewed and revised district board policies and administrative regulations. Our experience includes working with a number of merit systems in both school and community college districts. We also act as counsel for some school district personnel commissions, a position that has provided greater understanding of merit system issues. Many attorneys in our firm have previously been employed as teachers, administrators and as in-house counsel with school districts. These are experiences that provide a unique perspective on the needs and priorities of public education agencies.
