Kelly R. Minnehan is a senior associate in the San Diego area office.  Ms. Minnehan provides rapid, accurate legal advice and representation to school boards and school administrators on legal issues concerning employees, students, parents, labor associations, and the public. Ms. Minnehan handles a variety of areas of law, including constitutional rights; ADA/FEHA analysis and compliance; benefits and payroll; the Brown Act; collective bargaining; and discrimination. These matters may involve a myriad of employment issues, including certificated and classified employee discipline and dismissal, non-reelections, proper classification of employees, and suggested language for disciplinary and other types of meetings with employees. Ms. Minnehan's expertise includes FMLA/CFRA; injunctions; Interactive Process; labor relations, including matters before the Public Employment Relations Board; layoffs; merit systems; Public Records Act; student health services; student discipline; transfers and boundaries; torts; and investigating complaints alleging various topics including physical abuse and sexual harassment. 

Ms. Minnehan is also a successful litigator for public school districts.  She has tried certificated employee layoff and teacher dismissal cases before the Office of Administrative Hearings, including securing a unanimous CPC Decision dismissing a 20+ year teacher with close union ties.  She has successfully defended discrimination, tort/personal injury, and other claims in state courts.  In addition, Ms. Minnehan has successfully defended school district employers against various discrimination claims at the Department of Fair Employment and Housing and the Equal Employment Opportunity Commission. 

Ms. Minnehan enjoys interacting with board members and all levels of school district administrators, whether by providing advice and analysis in Closed Sessions, in one-on-one counseling and training sessions, or in presenting training sessions to groups of any size.  

Ms. Minnehan earned her law degree from the University of Georgia School of Law, her Master of Education degree from Salisbury State University, and her B.A. in English from the University of California at Irvine.  Prior to joining the legal profession, Ms. Minnehan was certified to teach English in the state of Maryland.
